Terms and Conditions
General Terms and conditions
1 - You confirm that you are at least 20 years old. Please note that you must provide on request valid proof of age if we believe you to be under the age of 20. If you are unable to provide valid proof of age on request your membership may be terminated.
2 - You confirm you have read,and signed the gym rules & Waiver.
3 - Your membership can only be used by you, membership is issued solely for your use, as your membership is personal to you and only covers your use of the gym.
4 - You agree to comply with SoCal Gym Membership Rules and you agree to use the gym facilities and equipment in the proper manner. You must consult a member of staff if you are unsure.
We are not liable for any injury you suffer through the incorrect use of our equipment or facilities.
5 - You will be liable for any damage caused to our equipment or facilities through your negligent use.
6 - You agree to tell us immediately of any changes to your personal details, including contact information and medical history.
7 - While using the facilities you accept responsibility for your state of health and physical condition. You should not take part in any physical activity that you may not be fit for. If you suffer any unusual symptoms when using the gym facilities, you must immediately stop the activity and tell a member of staff.
Membership & Cancellation
1 - Your membership can be cancelled if you violate the gyms rules.
2 - You can request to cancel your membership and give us notice by contacting the reception team. For cancellations we require 30 days notice. We will send you confirmation by email once we have processed your cancellation. Which will include final membership date. Please tell us if you do not receive this.
3 - If your circumstances change significantly and make it impossible for you to use the gym (such as for medical reasons, job loss, or moving house further than 5 miles from your home club), you can cancel without notice period. Contact our member services team, and provide suitable evidence to support (such as doctor's note or notice of termination of employment).
4 - From time to time we may need to increase the price of membership. We will give you at least 1 full months' notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership will cost after the increase. During this period, you will have your usual right to terminate your membership in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice, then the price of your membership will be increased in accordance with our notice
Car Park and personal belongings
1 - SoCal Gym does not take liability for theft or for loss or damage to your property or personal items in the gym or the car park.
It is your responsibility to ensure that your valuables are kept safe and secure.
2 - You are only entitled to use the car park whilst you are using the facilities.
3 - Cars are parked at the owners own risk. We do not accept liability for any loss or damage to vehicles or personal belongings.
Lockers
1 - For security reasons and the benefit of other members you must ensure that all lockers are emptied at the end of each visit.
2 - All lockers will be checked and emptied at the end of each day. If any contents remain we will retain any belongings for four weeks after removal after which we reserve the right to dispose of the contents in a responsible manner. We will not be responsible for any loss in this regard.
Additional services
1 - Personal Training Sessions and “additional services” do not form part of this Agreement and are not provided
2 - Any “additional services” (including, for example, Personal Training Sessions, Sports Therapy and Massage Therapy) which you contract for or agree to pay for, do not form part of your Membership Agreement and the Terms & Conditions of this Agreement will not apply to them. You should be aware that if you enter into any agreement for “additional services”, you are entering into an agreement with those individuals and not with us.
3 - We do not accept any liability for any losses, damage, personal injury or other loss caused by any negligent act or omission of those providing the “additional services” which are specifically excluded from the Membership Agreement and We do not accept any responsibility for the same save where precluded by law.
Mobile Phone/Photography Policy
1 - You must not take any photograph or video recording of any person in any centre without their prior consent.
2 - If another member makes a complaint to us about any photograph or video recording that you have taken in any centre, then we may ask you to show us any photograph or video recording that you have taken in our centre and to delete that photograph or video recording.
3 - You must immediately stop taking any photograph or video recording in our centres if requested to do so by any staff member.
Social media
1 - We operate a safe environment for our staff and guests. As part of that safe environment we ask all guests to use social media in an appropriate manner, having regard to other individual’s privacy.
2 - Any use of social media identifying our staff or our guests or revealing their personal details will be taken as a serious breach of these terms and conditions and may result in your membership being terminated.
Data protection
1 - We agree to comply with all relevant Data Protection Legislation which for the purpose of this Agreement shall mean the UK Data Protection Legislation and any other European Union legislation
2 - It is important that we hold the most up-to-date contact details for you. You are responsible for keeping all your personal contact details and choices for how you want to receive marketing materials up to date.
3 - We will keep any medical information you give us confidential and secure and only pass it to, or receive it from, those involved with your programme. By joining one of our membership options, you are giving us permission to share relevant clinical information that relates to your health goals between members of our staff.
4 - By signing these waivers and terms you are consenting to the use of CCTV recording whilst on the gym floor which we may refer to or provide to third party services, e.g police if an incident was to occur which would require the footage to be examined.
TERMINATION/SUSPENSION
1 - We reserve the right to terminate membership for any of the following:
- breach of rules and regulations;
- breach of these General Terms and Conditions of Use;
- conduct which, in our reasonable opinion, is damaging to the character or interest of SoCal Gym or is offensive to other members or staff, hazardous to the health and safety of other members or staff or of significant impediment to the enjoyment of other members.
2 - We retain absolute discretion to reject any application or renewal of membership without giving any reason for doing so.
3 - Membership of the gym may be suspended by us if there are any irregularities regarding payments. We reserve the right to appoint a third party to recover outstanding membership fees. Access to the gym may at our discretion be denied until these issues have been resolved.
